This Privacy Policy explains how [LEGAL ENTITY NAME], trading as First December Films ("First December Films", "we", "us", "our"), collects, uses, shares and protects personal data when you visit this website, send us a brief, apply for a role, or work with us on a production.
We are the Data Fiduciary for the personal data described here, as that term is used in India's Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025.
The short version
We are a film production company, not a data business. We collect the minimum we need to answer an enquiry, assess an application, run a production, and keep the website working. We do not sell personal data. We do not run advertising trackers. You can ask us what we hold, ask us to correct it, and ask us to delete it.

- Prospective and existing clients, agency contacts and brand teams who send us briefs or enquiries
- People who apply for a role, or send us a reel, showreel link or portfolio
- Directors, crew, cast, freelancers and vendors who work with us on productions
- People who contact us by email, phone or WhatsApp
It does not cover third-party websites we link to, or the privacy practices of the agencies and brands we work with, who are responsible for their own handling of personal data.
3. What personal data we collect
Data you give us directly
- Contact form submissions. First name, last name, email address, phone number including country dialling code, and the contents of your message.
- Direct email and phone contact. Anything you send to our team addresses, including mail@1stdecember.com and the individual producer addresses listed on our contact page, and any details you give us by phone or WhatsApp.
- Briefs and scripts. Campaign documents, scripts, storyboards, decks and reference material sent to us as part of an enquiry or a bid.
- Career applications and spontaneous submissions. Name, contact details, CV or resume, showreel and portfolio links, work history, references, and anything else you choose to include when you apply for a role or send us your work.
- Production data. If you work with us on a shoot, this may include identity and contact details, bank and payment details, PAN or GSTIN, government ID where required for insurance, permits, location access, visas or travel bookings, emergency contact details, and signed releases and consents.
Data we collect automatically
This website is built and hosted on Webflow. Webflow's servers process standard technical information as part of serving any page, including IP address, browser and device type, operating system, and the page requested. Strictly necessary cookies are set to make pages, forms and security work.
We do not currently run Google Analytics, a Google Tag, or any advertising or behavioural tracking on this site, and site-level analytics data collection is switched off. If that changes, we will update this policy and add a cookie consent control before any non-essential tracking is enabled.
Data we receive from others
- Referrals and introductions from agencies, brands, producers and industry contacts
- Publicly available professional information, such as a public LinkedIn, Vimeo, IMDb or Instagram profile, where it is relevant to an enquiry, an application, or casting and crewing
- Information from co-production partners, production service companies and vendors engaged on a project
What we do not want
Please do not send us financial account credentials, passwords, health information, or copies of government identity documents unless we have specifically asked for them for a production requirement. If you send us data we did not ask for and do not need, we will delete it.
4. Why we process personal data
- To respond to enquiries and briefs, including preparing treatments, estimates and proposals.
- To deliver productions, including scheduling, crewing, casting, budgeting, permits, insurance, travel, payments and delivery.
- To assess applications for employment, freelance engagement, and director or crew representation.
- To administer our business, including invoicing, accounting, tax and statutory filings, and record keeping.
- To operate and secure the website, including diagnosing errors and preventing abuse.
- To meet legal obligations and to establish, exercise or defend legal claims.
Our basis for processing
Under the Digital Personal Data Protection Act, 2023, we process personal data either on the basis of your consent, or on a legitimate use recognised by the Act. In practice:
- Consent covers any use of personal data beyond what you provided it for. Where we rely on consent, you gave it voluntarily and you can withdraw it at any time.
- Voluntary provision for a specified purpose covers the situation where you give us your details so we can respond to your enquiry or process your application, and you have not indicated that you object to that use.
- Employment purposes covers processing relating to recruitment, engagement, and the safeguarding of confidential information and business interests.
- Legal compliance covers processing we are required to carry out under Indian law, or in compliance with a judgment, decree or order.
Withdrawing consent does not affect processing carried out before the withdrawal, and it may mean we can no longer provide something you asked for.
5. Confidentiality of briefs and scripts
Briefs, scripts and campaign information sent to us by a prospective or existing client are treated as commercially confidential. We share them internally only with the people who need to see them in order to respond, and with directors, heads of department and vendors under confidentiality obligations where their input is required to prepare a treatment or an estimate.
This is separate from our position on unsolicited creative material, which is set out in our Terms and Conditions. Please read that section before sending us any unsolicited idea, script or concept.
6. Cookies and third-party embeds
Cookies on this site fall into two groups.
- Strictly necessary. Set by Webflow so that pages load, forms submit, and basic security works. These cannot be switched off, and no consent is required for them.
- Third-party embeds. Films on this site are served through Vimeo and YouTube, and our contact page includes an embedded Google Map. When one of those players or maps loads, the provider may set its own cookies and receive your IP address, subject to its own privacy policy. Some page assets and fonts are also served from third-party content delivery networks.
We do not use cookies for advertising, and we do not build advertising profiles. You can block or delete cookies in your browser settings, though parts of the site may not work as intended if you block the strictly necessary ones.
This site also includes buttons that open an AI assistant such as ChatGPT, Claude, Perplexity, Grok or Google AI Mode with a question about First December Films pre-filled. These are ordinary outbound links. We do not send your personal data to those services. Once you arrive there, that provider's own terms and privacy policy apply.
7. Who we share personal data with
We do not sell personal data, and we do not share it for anyone else's marketing.
We share personal data only where it is needed, and only with:
- Service providers who process data on our behalf, including our website host and form handling (Webflow), our email and file storage providers, and our accounting and payroll providers.
- Production partners where required to deliver a project, including agencies, clients, co-production and production service companies, casting directors, line producers, post-production facilities, insurers, and location and permit agencies.
- Professional advisers, including auditors, lawyers and bankers.
- Government and regulatory authorities, where required by law, including tax authorities and, where a film requires it, certification and broadcast compliance authorities.
- An acquirer or successor, if the business or part of it is reorganised, sold or transferred, subject to this policy continuing to apply.
8. Transfers outside India
Some of our service providers store or process data outside India. Under the Digital Personal Data Protection Act, 2023 and the Rules made under it, personal data may be transferred outside India unless the Central Government restricts transfers to a particular country or territory by notification.
Where we transfer personal data outside India, we do so under contractual terms requiring the recipient to protect it, and we comply with any restrictions in force at the time. If you work with us on an international production, your data may also be processed in the country of the shoot for permits, insurance, travel and payment purposes.
9. How long we keep personal data
We keep personal data only for as long as we need it for the purpose it was collected for, or for as long as the law requires.
- Enquiries that do not become projects: up to 24 months from the last contact.
- Client and project records: for the life of the engagement, and then for the period required by tax, accounting and contract limitation rules under Indian law.
- Career applications: up to 12 months from the date of application, unless you ask us to keep your details on file for future roles, in which case up to 24 months from your last contact with us.
- Crew, cast and vendor records: for the period required for statutory, tax and insurance purposes.
- Talent releases and rights documents: for as long as the film they relate to is in use, and then as needed to defend legal claims.
Where the Rules require us to give notice before erasing personal data, we will do so at least 48 hours before the erasure period ends, using the contact details we hold for you.
10. Your rights
Subject to the exemptions in the Act, you have the right to:
- Access. Ask for a summary of the personal data we hold about you, how we are processing it, and who we have shared it with.
- Correction, completion and updating. Ask us to correct data that is inaccurate or misleading, complete data that is incomplete, and update data that is out of date.
- Erasure. Ask us to delete your personal data, unless we are required to keep it by law or for the purpose it was collected for.
- Withdraw consent. Withdraw consent as easily as you gave it, for any processing based on consent.
- Nominate. Nominate another individual to exercise these rights on your behalf in the event of your death or incapacity.
- Grievance redressal. Raise a complaint with us about how we have handled your personal data or your request.
How to make a request
Write to mail@1stdecember.com with "Privacy" in the subject line, and enough detail for us to identify you and understand what you are asking for. We may ask you to verify your identity before we act, so that we are not disclosing someone else's data.
We will respond within 30 days of receiving a complete request. If we need longer, or if we cannot act on a request, we will tell you why within that period.
If you are not satisfied
Raise it with us first at the address above, so we have the opportunity to put it right. If you remain unsatisfied, you may make a complaint to the Data Protection Board of India in accordance with the Digital Personal Data Protection Act, 2023 and the Rules made under it.
Your duties
The Act also places duties on individuals. Please give us accurate information, do not impersonate anyone else, and do not file false or frivolous complaints or requests.
11. Children
This website and our services are directed at businesses and professionals, not at children. Under Indian law a child is anyone under the age of 18.
We do not knowingly collect personal data from children through this website. Where we process a child's personal data in connection with a production, for example a child artist in a commercial, we obtain verifiable consent from a parent or lawful guardian, we do not carry out tracking or behavioural monitoring of children, and we do not direct advertising at them.
Enquiries and career applications should only be submitted by people aged 18 or over. If you believe a child has given us personal data through this website, contact us and we will delete it.
12. Security
We maintain reasonable technical and organisational security safeguards appropriate to the data we hold. These include access controls and role-based permissions, encryption of data in transit, secured cloud storage, confidentiality obligations in our contracts with crew and vendors, and restricting access to production and payment data to the people who need it.
No system is completely secure. If a personal data breach occurs, we will notify the Data Protection Board of India on becoming aware of it, and notify affected individuals within 72 hours, with a description of the breach, the data involved, the steps we are taking, and what you can do to protect yourself.
13. Third-party websites and platforms
This site links to and embeds content from third-party platforms, including Vimeo, YouTube, Instagram, LinkedIn, Google Maps and WhatsApp. We do not control those platforms and we are not responsible for their content or their privacy practices. Their own terms and privacy policies apply when you use them.
14. If you are in the EEA or the United Kingdom
We are based in India and our processing is governed by Indian law. Where the EU or UK General Data Protection Regulation applies to our processing of your personal data, we will also honour the rights available to you under it, including access, rectification, erasure, restriction, portability and objection, and you may complain to your local supervisory authority. Contact us at the address above and we will deal with your request on that basis.
15. Changes to this policy
We may update this policy as our practices, our services or the law change. The date at the top shows when it was last updated. Where a change materially affects how we use your personal data, we will take reasonable steps to bring it to your attention.
