These Terms and Conditions govern your use of this website and any material on it. 1. What this website is

This website is a portfolio and information resource for an advertising film production company. It describes who we are, the work we have made, the directors we represent, and the services we provide.

Nothing on this website is an offer, a quotation, a warranty of availability, or a commitment to produce anything. Any engagement with First December Films is governed by a separate written agreement, purchase order or letter of engagement signed by both parties. If there is a conflict between these terms and a signed production agreement, the signed agreement takes precedence for that project.

2. Intellectual property in our work

All content on this website, including films, commercials, showreels, behind-the-scenes material, stills, text, design, layout, graphics, logos, and the arrangement of them, is owned by First December Films or by our clients, agencies or licensors, and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and applicable international law.

You may view the site and share links to it. You may not, without our prior written permission:

• Download, copy, rip, screen-record, mirror or re-host any film, clip, still or showreel from this site
• Reproduce, republish or distribute any content, in whole or in part, on any platform
• Use any content in a pitch, a treatment, a reel, a portfolio or a mood film
• Use any content to train, fine-tune or develop any machine learning or artificial intelligence model
• Use any content for commercial purposes of any kind
• Remove, obscure or alter any credit, watermark or proprietary notice
• Use automated systems to scrape, harvest or extract content, other than search engines and crawlers operating within the directives in our robots.txt

Client brands and campaign names

Brand names, logos, campaign titles and trade marks appearing in our work belong to their respective owners. They appear on this site solely to identify work we have produced, as a portfolio credit. Their appearance does not imply any endorsement of First December Films by those owners, nor any current or ongoing commercial relationship, unless separately stated.

Rights in commissioned work

Ownership, usage rights, territory and term for any film we produce are set out in the production agreement for that project. Nothing on this website grants or transfers any right in a commissioned film.

3. Unsolicited submissions

Please read this section before sending us anything.

We receive a large volume of scripts, treatments, concepts, story ideas, formats and creative suggestions. We also develop our own work continuously, and we receive briefs from agencies and brands that may cover similar ground by coincidence. To protect everyone involved, we operate a clear policy.

We do not accept unsolicited creative ideas, scripts, treatments, concepts or formats. If you send us any such material without a prior written request from us, then:

• It is submitted on a non-confidential basis, and no confidential relationship is created
• We are under no obligation to review it, respond to it, return it or keep it
• We are under no obligation to pay for it, credit it, or account to you in any way
• We may already be developing, or may in future independently develop, work that is similar or identical, and you agree we are free to do so without liability to you

This does not apply to a brief, script or campaign document sent to us by a prospective or existing client, an agency, or a production partner in the ordinary course of a commissioning or bidding process. Those are treated as commercially confidential, as described in our Privacy Policy.

Showreels, portfolios and career submissions

We welcome showreels and portfolios from directors, crew and prospective team members. When you send us a reel, a portfolio or an application, you confirm that you own it or have the right to share it, and you give us permission to view, store and circulate it internally for the purpose of assessing you for representation, employment or engagement. We will not publish, exhibit or commercially exploit your material without your written permission.

4. Enquiries, forms and messaging

When you use our contact form, apply for a role, or reach us by email, phone or WhatsApp, you agree to provide accurate information and not to impersonate any person or organisation. We handle the personal data you send in accordance with our Privacy Policy.

Submitting an enquiry does not create a contract, a reservation of dates, or an obligation on us to bid, quote or respond. Messages sent through WhatsApp are transmitted through a third-party service operated by Meta, subject to its own terms.

5. Accuracy of information

We work to keep this website accurate and current, but we do not warrant that it is free of errors or omissions. Credits, award records, client lists, availability, capabilities and service descriptions may change. Awards and recognitions listed reflect our records at the time of publication.

Editorial content in our Blogs and Insights section, including guidance on budgets, timelines, production process and regulatory requirements, is provided for general information only. It is not legal, financial, tax or professional advice, and it does not take account of your specific circumstances. Any production cost ranges given are market indications, not quotations, and no quotation is made until it is issued to you in writing. Take your own advice before acting on anything you read here.

6. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in breach of any applicable law
• Introduce any virus, trojan, worm or other malicious code
• Attempt to gain unauthorised access to the site, its server, or any connected system
• Interfere with the proper working of the site, including through denial of service or excessive automated requests
• Impersonate First December Films or any of our partners, directors, producers or team members

We may suspend or restrict access to the site, or to any person, where we reasonably believe these terms have been breached.

7. Third-party links, embeds and platforms

This site contains links to and embeds from third-party platforms, including Vimeo, YouTube, Instagram, LinkedIn, Google Maps and WhatsApp. It also contains buttons that open an AI assistant such as ChatGPT, Claude, Perplexity, Grok or Google AI Mode with a question about First December Films pre-filled. These are ordinary outbound links.

We provide those links and embeds for convenience. We do not control those services, we do not endorse or verify their output, and we are not responsible for their availability, accuracy, terms or privacy practices. Any summary of First December Films generated by an AI assistant is that provider's output, not a statement by us, and should not be relied on.

8. Disclaimers

The website and its content are provided on an "as is" and "as available" basis. This clause governs liability arising from use of the website only. Liability in relation to a production is governed by the production agreement for that project.

You agree to indemnify and hold harmless First December Films, its partners, directors, employees and agents against any claim, loss, damage, liability, cost or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the website or its content, or your infringement of any third-party right in material you send us.

11. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these terms. That policy also explains which cookies this site sets and which third-party embeds may set their own.

12. Careers and applications

Job listings on this website describe roles as they stand at the time of publication. A listing is not an offer of employment or engagement. We may amend, withdraw or close a listing at any time. Compensation ranges, where shown, are indicative and subject to experience, scope and negotiation. Any offer is made only in writing and is subject to our standard terms, references and applicable checks.

Applications should be submitted only by people aged 18 or over.

13. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the laws of India.

The courts at Mumbai, Maharashtra have exclusive jurisdiction, and you agree to submit to that jurisdiction.

14. General

• Changes. We may update these terms at any time. The version published on this page at the time you use the site is the version that applies. The date at the top shows when it was last updated.
• Severability. If any provision is found to be unenforceable, the remaining provisions continue in full effect.
• No waiver. A failure or delay in enforcing any provision is not a waiver of it.
